Operator and scope
These terms govern bookings for excursions offered by Waves and Dreams di Eleonora Locci, VAT no. 04175770926, REA CA-369373, registered office at Via Carlo Rosselli 5, 09047 Selargius (CA), Italy, email info@wavesanddreams.it, certified email elocci@legalmail.it, telephone and WhatsApp +39 331 257 0411.
The person making the booking must be at least 18 years old, acts also on behalf of the other participants listed and confirms that these terms have been made available to them.
Booking process and contract formation
The customer selects the experience, date and participants, checks availability and price, enters the required information and completes payment through Stripe. An order summary is displayed before payment. The contract is concluded when payment is authorised and the system sends confirmation with the booking code, subject to the minimum-participant condition for shared excursions.
Online bookings normally close 24 hours before departure. Later requests may be considered by contacting Waves & Dreams directly, without any guarantee of availability.
Prices and payment
Prices are stated in euros and include the services listed in the experience description and booking summary. Services not expressly included remain at the customer’s expense. Payment is made online through Stripe using the methods available at Checkout. Waves & Dreams does not receive complete card details.
Shared excursions and minimum number
Shared excursions require the minimum total number shown on the website, currently 4 participants. Payment reserves the seats, but the shared departure becomes final when the minimum is reached. All participants, including children, count towards capacity and the minimum.
If the minimum is not reached, Waves & Dreams will notify the customer as soon as possible and offer either a compatible alternative date or a full refund to the original payment method.
Private excursions
For private excursions the boat is reserved for the group stated in the booking. The price is based on the selected capacity band and total number of passengers. Separate child reductions do not apply unless expressly stated in a promotion.
Children’s rates and capacity
For shared excursions, children aged 0–3 travel free of charge and children aged 4–12 receive a 50% discount, unless the booking summary states otherwise. All children occupy a place and count towards capacity and the minimum. Their number and age group must be declared accurately.
Cancellation by the customer
The customer is entitled to a full refund when cancellation is communicated at least 7 calendar days before the scheduled departure time. After that deadline the price is non-refundable, unless Waves & Dreams decides otherwise or agrees in writing to reschedule the booking.
The request must identify the booking and the date of the communication, preferably by replying to the confirmation email or writing to info@wavesanddreams.it. Refunds are issued to the original payment method; the time required for the credit to appear depends on the payment network and the customer’s bank.
Cancellation or changes by Waves & Dreams
Safety takes priority over the planned itinerary. Unsafe weather or sea conditions, official restrictions, breakdowns, unavailability of the boat or skipper, failure to reach the minimum and other circumstances that could not reasonably be avoided may result in a change, postponement or cancellation.
If Waves & Dreams cancels, the customer may choose a compatible alternative date or a full refund of the amount paid for the cancelled service. External expenses not purchased directly from Waves & Dreams, such as travel, parking or accommodation, are not refundable.
Rescheduling
Requests to change the date are subject to availability and require express acceptance. An agreed change does not alter the price unless the experience, capacity band, season, number of participants or requested services change. Any difference will be communicated before confirmation.
Departure time, meeting point and no-show
The customer must arrive at the meeting point stated in the confirmation with sufficient time and with the declared participants. A delay that prevents departure, a no-show or withdrawal after the scheduled time does not entitle the customer to a refund. The departure point and itinerary may be adapted for operational or safety reasons.
Conduct, safety and skipper’s instructions
Participants must follow the skipper’s instructions, use safety equipment correctly and behave prudently and respectfully. Boarding while affected by alcohol or substances that impair safety, bringing dangerous items or acting in a way that puts people, the boat or the environment at risk is prohibited.
The skipper may refuse boarding or stop the experience where a participant’s conduct creates a genuine safety risk. Where the cause is attributable to the participant, no refund is due.
Children, personal conditions and accessibility
Children must be accompanied and supervised by a responsible adult. Before booking, the customer must communicate mobility needs, allergies or other relevant conditions only to the extent necessary to assess whether the experience can be carried out safely. In case of doubt, Waves & Dreams should be contacted before payment.
Itineraries, duration and services
Times, duration, stops and itineraries are indicative and may change due to sea, wind, marine traffic, official instructions, safety and the skipper’s decisions. Reasonable changes that do not alter the essential nature of the experience do not constitute a breach of contract.
Personal belongings and liability
Participants remain responsible for their personal belongings. Waves & Dreams is liable within the limits established by law and does not exclude or limit liability where mandatory law prohibits this. Damage caused by inaccurate information supplied by the customer, failure to follow instructions or events not attributable to the operator remains excluded to the extent permitted by law.
Statutory right of withdrawal
Because the booking concerns a leisure activity to be provided on a specific date or during a specific period, the general 14-day statutory right of withdrawal for distance contracts does not apply under Article 59 of the Italian Consumer Code. The more favourable cancellation and refund policy stated on this page remains applicable.
Complaints, dispute resolution and applicable law
Complaints should be sent to info@wavesanddreams.it or elocci@legalmail.it, including the booking code and a description of the issue. The parties will first attempt to reach an amicable solution.
Consumers may also contact a competent ADR body recognised by national or European authorities. Mandatory consumer rights and the jurisdiction of the courts of the consumer’s residence or domicile, where provided by law, remain unaffected. Italian law applies to matters not governed by mandatory rules.
Current version
The terms accepted at the time of booking apply to that booking. Updates apply to later bookings unless required by law or more favourable to the customer.
